						 <p>In the Plessy Vs. Ferguson case Homer Plessy said that he paid for a First class ticket to ride a train in Louisiana although he was 1/8 black. John Howard Ferguson the judge presiding over his case said that Plessy was in violation of Louisiana's Separated car act of 1890. the judge stated that since Homer Plessy bought the train ticket on July 7, 1892 the Separated Car Act of Louisiana applied to him. He was 1/8 black which is what enforced this act upon him. The train company had actually given Homer Plessy the money to purchase the ticket in the first place. The judge actually believed that trains passing through Louisiana were not to be enforced by this law.</p>

						 <p>Speaking on behalf of the Nice Noodles and the United States of America, I believe that the United States government is responsible for the safety of its citizens. According to Article 2 Section II of the Constitution, the President as commander in chief of the military gets the right to issue orders to help the military protect the nation. This includes Order 9066, which allows restrictions on the movements and prescence of groups in certain areas of the country. When there are threats to the citizens of the USA, the Government must take action. There is obviously a war going on, and it is necessary to ensure the citizen's safety from potential threats within the nation. As for the case of Korematsu specifically, Korematsu was a Japanese American living in the USA. He knew according to law that the US needed to temporarily detain the Japanese Americans, yet he ran away, changing his name and face and pretending to be a Mexican American. Why would one do this if they didn't have something to hide? I'm sure I'm not alone when I say that this action is more than a little suspicious. What WAS Korematsu hiding? How many more Japanese Americans had something to hide? This was something impossible to determine at the time. I'm sure you've heard the saying 'better safe than sorry'. The USA knew for a fact that there were Japanese American conspirators out there. It is not as if this action is without good reason. It would be impossible ot seperate out the guilty from the innocent. That will have to be done over time. Until then, it is necessary to keep the citizens of the USA safe. And that is what the government will do.</p>

						 <p>This is the thesis statement for the Appellate for the Brown vs. Board. In this case, a young African American girl in 3rd grade went to an all black school named Monroe in Kansas. Although she lived only 7 blocks away from an all white school, she had to walk a little further to get to her all black school. She argued it to be unfair that she had to walk so far, and thought that she should be able to go to the school nearest to her home. The Board argued that the schools are equal but separate. The Kansas Law states that a population over 15,000 can segregate their schools. The population in 1950 was around 80,000. In this case, the Board's decision was based on the Plessy vs. Ferguson case. In the Plessy vs. Ferguson case Ferguson won. They stated that train cars were separate but equal. This situation is exactly like the two segregated schools. The schools are separate, but they are still equal.</p>

						 <p>In the case of Bakke v California, Bakke applied for the the University of California. Bakke was rejected from the University because the average applicants had to get above 2.5 on the 4.0 scale. (average white person). Later Alan Bakke found out that there was special admissions for &quot;minority groups&quot;, the applicants for the university that went through this program for the &quot;economically and/or educationally disadvantaged&quot; were accepted to the University of California with a lower grade point average than than 2.5 on the 4.0 scale. The people accepted to this group were accepted because of their race. This program was only accepting &quot;Blacks&quot;, &quot;Chicanos&quot;, &quot;American Indians, and &quot;Asians&quot;. The average white person was not able to be admitted through this program. Allan Bakke filed a law suit against the University of California saying that this program violated the Equal Protection Clause of the 14th Amendment. The university took it to the Supreme Court because they wanted this program but they lost because they found that it did violate the 14th Amendment and you cannot admit students because of their race. Bakke was then accepted to the University and won the case.</p>

						 <p>This is the thesis statement for the Petitioner on the Marbury v. Madison. In this case, Marbury was promised a position in the cabinet by John Adams. When Thomas Jefferson became the President, he ordered Madison to cease handing out commissions. Marbury's commission had already been signed, and all that was left to do was hand it to him. The Constitution did not say if it was the signing of a commission or the having it in your hand that made you a member of the courts. What significance does giving it to someone have? The commission was signed and thats all that matters. Also, you cannot say that it is fair and just that others got their promised position, but Marbury did not. This is why Marbury should have won this case and been appointed as a Justice.</p>

						 <p>Our argument for Scott's side is that he is a free man because while he was enslaved he was taken into territories where slavery is illegal. Throughout the united states it was an accepted idea that once a slave is in free territory that slave is always free and is a free man. In this case Scott and his family were taken to free territory by their master and left. While they were living in this free territory, Scott received mail. Now when he returned to his owners estate and asked to work for his freedom he was a free man. As a result of being a free man Mrs. Emerson committed battery and false imprisonment by enslaving Scott once more. Also if he was a &quot;slave&quot; why was it that he was able to sue his owner? Also if he was not a free man why was he able to receive male while living in current day Minnesota.</p>

						 <p>Our economy is obviously in a very poor state now. There are not many jobs to be found, so there are low employment rates. How do we change this? Simple: by lowering interest rates. Yes, the government is in a huge debt but &quot;the economy goes through repeated periods of growth and contraction&quot; (informedtrade.com). There have been horrible times in our economy that have been just as poor as these, and we have come through these simply because <em>it is normal for our economy to fluctuate</em>, even if this isn't always good. 						 <p>Well things haven't really got any better from 0'8 . One thing i can say is that gas prices has come down from 0'8. Americans battered by the recession have found modest consolation in low gasoline prices, a salve that's likely to last as long as the economic downturn. Oil company cutbacks may raise gas rices down the road. Oil companies ar coming up with new investment and production. This what is going on in the economy with the gasoline prices.</p>

						 <p>Under the constitution of the United States of America, Fred Korematsu cannot be moved to an internment camp. Doing so would violate his fifth constitutional right. This right states that “No person shall…be deprived of life, liberty, or property, without due process of law….”. Executive order 9066, which forced Japanese Americans into internment camps, breaks this right. None of these Japanese were sentenced to any sort of crime. In fact, none of them were even given a trial, or a chance to plead innocent. Thus they are being denied life, liberty and property without any process of law, due or not.</p>

						 <p>Even through an order was filled out for Marbury to become a judge, the commission was not delivered and therefore Marbury should not be on the Supreme Court. The reason Marbury did not receive his commission was because of a failure on the part of John Marshall, the previous secretary of state. Therefore, it was the negligence of Marshall that stopped Marbury form becoming a judge, and Madison should not be penalized and issued an order by the Supreme Court because of poor follow-through on the part of John Marshall.<br /> Nathaniel.</p>

						 <p>In the Plessy v Ferguson case we encounter the situation of race being the issue and in <strong>1896</strong> that is exactly what occurred. A group of African-Americans wanted to test the Separate Car Act, they raised $3,000 to challenge the Act, and The East Louisiana Railroad Company also wanted to terminate this act. They decided to choose Homer Plessy for job who was one-eight African-American. In <strong>1892</strong> he purchased a first class passage from New Orleans to Covington, Louisiana and sat in the section for whites. Of course this was illegal so they arrested him and charged him with violating the Separate Car Act. Albion Tourgee, a white lawyer, agreed to argue the case. Plessy argued that the Separate Car Act violated the Thirteenth and Fourteenth Amendments.</p> <p><strong>Thirteenth Amendment</strong><br /> <strong>Section 1.</strong><br /> Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.</p> <p><strong>Fourteenth Amendment</strong><br /> <strong>Section 1.</strong><br /> All persons born or naturalized in the United States and subject to the jurisdiction thereof are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.</p> <hr /> <p>John Howard Ferguson was the judge over Plessy's criminal case in the district court. Plessy's case he decided that the state could choose to operate railroad companies that operated only within the state of Louisiana. 						 <p>Side of California:<br /> I think Bakke should not be given a place in the University of California because they had a special program for minority students, and he had tried to get into the school using that program. Also the college was trying to get minority students, even if they didn't have really good GPA averages. Bakke was Caucasion, he was not a minority student. Just because he had a good GPA average doesn't mean that he would necissarily get in. He didn't not have a good reason to suie.</p>

						 <p>The Board of Education had every right in the world to not allow Linda Brown to attend an all-white school, for the following reasons. To begin with, the state of Kansas permitted cities of 15,000 people or more to have segregated schools. The federal courts would not have allowed this if they had thought it was unconstitutional. We were simply following the law. If you disagree with the law, don't attack the school. Try to get the law changed! Further more, although the United States Constitution says in the 14th Amendment &quot;No State shall… deny to any person within its jurisdiction the equal protection of the law&quot; treating people equally does not mean treating them the same way. If, for example, two patients came to a doctor with a headache. One of them had a simple stress-induced headache, and one of them had a brain tumor, the doctor would treat both of them equally, but would prescribe different medications and healing procedures to the man with the brain tumor. The doctor is treating them equally (no patient is ignored for the other) but treating them very differently. The same is true for the segregated schools. Federal inspectors examined both the white school and the black school, and found them to be the same. Same curriculum, same materials, etc. The white school was in no way being favored over the black by having better teachers or better books. Also, federally conducted tests showed that white students learned better with other white students, and black students learned better with other black students. And, going back to the problem of separate buildings, we have separate bathrooms for men and women. Should we eliminate that simply because two girls don't want to walk the extra distance between bathrooms? No! There are social standards that are allowed for the sake of helping society. And one of those is having separate schools for blacks and whites.</p>

						 <p>VIDEO<br /> The purpose of our video is to exhibit the ideas and concerns of Micah. We wanted to display what he stands for. To do this we used multiple propaganda techniques. These include Appeal to Authority, plain Folk and Pinpointing the Enemy. Appeal to Authority was demonstrated when it was proclaimed that Chris Gatewood, former Candidate winner, supported Micah. The technique of plain folk was presented by the clothing that Micah wore. He appeared to be an average citizen, which would illustrate a since of familiarity. The final type of propaganda used in our IMOVIE was Pinpointing the Enemy. There was a slide that showed pictures of all of the other Candidates not behaving or acting like the typical Candidate would perform. In conclusion, our IMOVIE was a device used as a campaign for Micah, and could be understand as a piece of propaganda.</p>

						 <p>I think propaganda should be used in political debates because if not then a lot of the things that the politicians say would come off less effective. Also propaganda is used in everyday advertising so it should therefore be used in politics. Politics wouldn't be the same without propaganda and things would be much harder to get out to the public.</p>

						 <p>Below are the facts of the case from landmarkcases.org</p> <p>Dred Scott was born a slave in Virginia around 1799. In 1834, a man named Dr. Emerson bought Dred Scott and they moved to Illinois, a non-slave (free) state. In 1836, they moved to Minnesota, also a non-slave state. There, Scott married another slave named Harriet. In 1838, the Emersons and the Scotts moved to Missouri, a slave state. In 1843, Dr. Emerson died, leaving his wife possession of the Scotts.</p> <p>Dred Scott sued Mrs. Emerson. He claimed that he was no longer a slave because he had become free when he lived in a free state. The jury decided that Scott and his family should be free. The Emersons did not like the decision and appealed to the Missouri Supreme Court in 1852. That court said that Missouri does not have to follow the laws of another state. As a slave state, Missouri's laws meant that Scott and his family were not free.</p> <p>Sanford moved to New York and left the Scotts in Missouri. Scott sued Sanford again in a federal court. Federal courts decide cases where the citizens live in different states. In 1854, the U.S. Court for the District of Missouri heard the case. Sanford won the case and Scott then appealed to the Supreme Court of the United States, the highest court in the country.</p> <p>When the case came to the Supreme Court of the United States, the country was in deep conflict over slavery. In the past, some slaves had successfully sued their owners for freedom. However, by the 1850's, many states were hardening their positions on slavery, making such cases more difficult to win. It would not be long before the country was in a civil war over the issue of slavery.</p>
